和社会层面上催生了discipline, 而不象韦伯更多的强调宗教伦理对个人心理行为的规范
。正是这种congreagational discipline at the congregational level形成了欧洲国家
的意识形态和组织管理的infrastructure.不纯粹象韦伯的讨论更多着眼于观念，伦理，
精神，这本书的探讨融入了很多社会结构的因素，甚至有一些功能主义的解释，在这些方
面都很象福柯。一整本的监禁与惩罚讲的不就是欧洲如何形成一个disciplinary
society的过程么？这个过程和Gorski讲的欧洲disciplinary state的形成不过是一体两
面而已啊，甚至是一面的不同说法。仔细看他们讲的那些社会制度institution 如何通过
micro-power来型塑作为抽象主体的人subjectivity，而他们却是整个主权国家（soverei
gn)的基础,是非常相似的。

再说饶毅、管坤良实验室联合发表的论文数据造假

昨天我发出《关于饶毅、管坤良实验室联合发表的论文数据造假的分析》后，
饶毅转给我他当天登在其微信公众号的文章《饶毅、管坤良就论文图片的分析》
（以下简称饶文），作为对“有人匿名散发指饶毅参与署名的9篇论文中图片有
造假问题”的回应。由于第6、7、8、9等四篇文章“不存在需要解释的地方”，
饶文称只需回应第1、2、3、4、5等五篇文章——对此我也同意，我在前文也只
分析了这五篇论文。
但是实际上饶文只回应了“饶毅需要负质量和监管责任的图片”，指的是这
两篇论文中的图片：

人集體控告國務院一事，他認為是因對移民法有誤解(Misconception)，若要根本地改

公平」的配額制度，中國移民只能寄望聯邦全面移民改革來更改法律。
今年5月21日，一批苦等職業移民排期多年的中國勞工向聯邦第九巡迴法庭提出了對國
務院、移民
局、國內安全部及其負責人的集體訴訟，狀告這些機構在2008、2009兩會計年大幅度削
減中國大陸
出生申請者的EB3簽證名額2300多個，要求補償其行政過失及歧視政策所造成的損失。
身為國務院律師主管的高斯基認為，導致訴訟的原因是「對法律和規定的誤解」，因為
現行移民法依
照國別多樣性原則，按比例(Pro Rata)分配給世界各國移民配額，每國配額上限為7%，

时候搞就职仪式，比这更啰嗦。当时都是多神教，五花八门，很热闹的。。演变到美国
这里，更多是象征意义，就跟国家博物馆，民族纪念碑，各种节日一样，是加强
symbolic power of state的一种方式。
倒未必能和合法性有太大关系，自政教分离以后，现代国家的合法性恰恰来自他
和教会的对立，为新教徒和其他异议者一种安全庇护（Gorski 1999）。美国当初建国
时都不让庆祝圣诞节，以免被教会渗透。。。在现代西方，民主或者独裁，合法性方面
更强调对暴力的垄断，和程序的正义/合适。。。
在中国，国家合法性之一就是ritual performance，祭天什么的。。。演变的今天，
ritual performance貌似消失了
