会重新处理第一次交的LCA？
如果需要重新申请，怎样才知道fein已经verified，应该什么时候申请？

斗争后，接受了公司的OFFER。公司开始找律师，办签证，我也递交了很多要求的材料
。半个月后以为律师都该要上报USCIS了，上周才知因为公司名称变更，报到了IRS，需
要从IRS拿到公司新的信和FEIN (根据具体办事的人的信息），然后才开始去加州劳工
部。因为我现在的位置一个月结束，很着急H1B是否能在这期间申请下来，尽管公司已
经答应加快。
烦劳有经验的朋友指点，这种情况大概需要耗费多长时间？我该怎么办？多谢了！！ |

表格一定也要交上去。
真想不通律师怎么能没有LCA就交H1B的申请呢？
以前LCA网上一分钟就能通过，现在基本7 business days,但是那个系统经常有FEIN的
错误，所以可能最长要花个15-20days if FEIN can't be found in that wired LCA
evaluation system http://icert.doleta.gov/

下面是时间表，给大家参考。
Offer accepted: June 17.
LCA filed June 17.
LCA denied June 21 due to fein error.
Fein verification proof sent to DOL June 21
Fein verified on June 28 by DOL
LCA filed again on June 28
LCA approved on July 7.
H-1B transfer filed July 7 to USCIS CSC PP.
Approved today.
Receipted on July 8 but never got any notice.

FEIN就递交LCA了，1个礼拜后才收到拒信。
然后律师找芝加哥那边验证了FEIN，2天后收到验证完毕的确认信，再次递交LCA，1周
后再次被拒，理由同样，说FEIN没有验证
nndx。衰到家了啊。这去argue去了也不知道啥时候才有个结果 |

error.我14号才看到email，赶紧email back.16号通知FEIN verified, 可以
resubmit LCA, 但我15号就又递了．21号晚上10点多通知LCA certified. 第二天22号
用USPS express mail next day delivery guarantee 寄出，23号移民局收到．23 号
是我OPT grace period 的最后一天，即第60天． |

帮助公司申请FEIN。 让我想起我刚毕业的时候，也是没什么好写的，什么都往上放，
其实并不会有很多用。甚至会有饭作用。
这个FEIN 申请，就是到IRS网站上，点点点。。。。几分钟就好了。建议这位同学把这
条拿掉，可以换上QUICKBOOK之类的，公司请人，QUICKBOOK熟练设置和使用是个很大的

Find your state's secretary of state website, and then find the business section, then find out the
registration/organization/formation form for LLC. Fill it out. Most of the states support online registration, the fee is less
than $50.
Then, you search FEIN, which is federal employment identification number- your tax ID, then apply it online. 30secs
later, you will have your FEIN!

原因是：

immigration case. Each FEIN is a separate employer in the context of
immigration.
It sounds like your company doesn't have its own immigration counsel other
wise you wouldn't need to worry about such details. Why don't you raise this
to the attorney who filed your H1B case for advice? |

S Corp, C Corp, 還有 Limited Liability Company 在稅務跟組成方式上都存在很大
的不同。
其中S CORP的股東必須是綠卡持有人，C CORP 和 LLC 則無此限制，另外分享公司利潤
方面和公司資產轉移到股東名下的做法也有分別。
置於法律責任方面，成立公司要先在SECRETARY OF STATE FILE， 置於FILE什麼文件就
要看成立LLC, C CORP 還是S CORP, file了之後才能申請FEIN。
FEIN只是跟稅務有關係，只要跟SOS FILE了，公司就算正式成立，可以用公司名義去簽

But the lawyer said that is not acceptable:
They only need one of the two following documents:
· Documentation from IRS noting assignment of FEIN
· Federal or State tax return (only acceptable with a pre-printed

The company does not have the notice form IRS for the FEIN
Also, the company only use the form download from the IRS for tax return.
