相关法规的计划进行表决，联邦通信委员会此举为所谓“网络中立性”划下句点。
美国联邦通信委员会（FCC）在14日废除网络中立规定（Net neutrality），此举将对
网络服务供货商、新兴网络公司和消费者带来重大影响。
“洛杉矶时报”报导，2015年民主党掌控的FCC通过网络中立规定，宽带网络服务提供
者不得封锁合法网络内容以及合法网络应用，也不得降速，或是以加速网络服务等手段
，额外收取优先服务费用。
为了执行这项规定，FCC把宽带网络服务提供者纳入电信法中类似公共事业规范的Title
II类别。
但今年1月，美国总统川普任命裴伊（Ajit Pai）担任FCC主席，裴伊是共和党人，他大
声疾呼要废除网络中立规定。 他认为，FCC 2015年决策背后的忧虑只是“歇斯底里的
丧气话”。 他并说，FCC设下“悬垂的高压规定”伤害宽带网络服务提供业，并且妨碍
扩大网络服务的投资。
FCC今天的表决预料将会遵循党的路线，FCC目前是占多数的共和党所控制。

通信公司避免使用中国华为技术和中兴通讯（ZTE）产品的表决。不仅将禁止新增采购
，针对现有的通信设备，也要求排除和更换两家公司的产品。明确指出这两家公司存在
风险。
FCC将把华为和中兴通讯列入禁止采购的企业名单（reuters）
将禁止利用旨在普及通信线路的FCC补贴的企业采购两家公司产品。对于现阶段
使用两家公司产品的企业，将在设备交换所需费用上提供支援。11月19日将实施FCC的5
名委员的投票。针对两家公司的产品，已在政府采购中禁止，今后将扩大至民营企业，

院认定美国联邦通信委员会有关禁止华为参与联邦补贴资金项目的决定违反了美国宪法
和《行政诉讼法》。这缘起于11月22日FCC通过的一项决定，将华为认定为美国国家安
全威胁，并禁止美国农村地区运营商使用通用服务基金购买华为设备。
在起诉书中，华为认为FCC直接认定华为构成国家安全威胁，没有给予华为就相关指控
进行反驳的机会，违反了正当程序原则。同时，华为同时认为FCC并未提供任何证据或
合理的理由来支撑其武断的决定。
实际上，从2018年3月起，FCC就首次提出了这项提议，期间，华为和美国农村地区运营
商提交了多轮事实依据和反对意见，但被FCC完全忽视。
FCC作为一家负责州际、国际通信的政府机构，尽管有义务保证美国无线电和电线通信

FCC诉讼分两种，informal and formal。我发的和网上教大家发的是informal
complaint，处理的部门为Consumer & Governmental Affairs Bureau Consumer
Inquiries & Complaints Division。这个部门只做技术上的回复，即我们所收到的回
信，称为form letter。真正有律师参与评估的部门在DC,必须发formal complaint才会
有他们参与进来。Formal complaint需在收到FCC对informal complaint回信的六个月

然也不知道FCC是怎么操作的，比方说JANET JACKSON的NIP SLIP你不DVR暂停回放根本
看不到，但是照样被人举报到FCC，FCC给CBS开罚单涵盖所有当天转播的CBS
AFFILIATIONS，电视台自然可以放成人片，要不你让SPICE, PLAYBOY, HOT这样的24小
时成人CHANNEL怎么活了，FCC对NETWORK TV, CABLE, PREMIUM CABLE有不同的要求，
PREMIUM CABLE可以不BEEP脏话，但是NETWORK就不可以，就是CABLE也不一样，COMCAST
曾经犯过一大错，某地区工作人员在迪斯尼卡通台中插播毛片，够厉害吧，COMCAST自
己赶紧认错了，但是FCC最后没有正式下罚单，一是COMAST自己人了，二是没有人举报
，等闲人发现新闻要举报时，事情都解决了 |

，哪里不对了，赶紧掐信号？LOL， FCC定规章制度，人家不会禁的，只会事后罚，而
且你问的也不是问题，都是你自己瞎琢磨出来的，美国所谓的禁播实际是SELF
CENSORSHIP，也就是媒体出于商业利益的考虑会自己主动掐掉某些可能引发争议的内容
，实际人真要播，比如让KLAN来侃侃而谈是可以的，FCC绝对不会管，但是观众会抗议
，所以电视台掂量一下，喜欢看KLAN的没有抗议的多，就不播了...

虽然请愿人数超过10万，白宫很可能说这些问题是FCC的管辖范围，政府会指定由FCC进
行调查，相信一定会给大家一个公平公正的答复，然后FCC继续拿第一修正案说ABC和
Kimmel的节目完全合法受法律保护，所以他们不可能管，白宫最后说既然专业部门都这
样说了，请大家都老老实实尊重法律和宪法。
所以大家辛辛苦苦搞个超10万人的请愿，轻而易举就被冷漠地化解了
各位还是考虑一下这之后该怎么办吧！除了打算发动更多人抗议白宫和FCC之外。
打铁还需自身硬，当主流媒体和社会认识不到华人的力量的时候，政策法规的解释执行

上kindergarten而且便宜，就报了FCC。当时也是只有4岁这个班没满。结果去了后才知
道为什么4岁的班不满。老师是个年纪很大的白人，孩子去了两天就对我complain两件
事：1 . 老师很mean。因为要带午饭，Houston一月还凉，我买了保温饭盒。中午孩子
打不开就举手叫老师。该老师回答自己开。孩子实在打不开，就没吃饭，直到另一个年
轻女老师来了帮着打开了。2. 老师不fair. 因为中午几乎没时间吃午饭，孩子只吃了
几口就睡了。下午snack时间吃cookie，孩子很饿，一个white boy吃完了又跟老师要，
老师马上给了，我孩子紧跟着也要，老师说下次再吃。孩子从没有behavior问题。孩子
问我，为什么老师对别人和自己不一样。我第二天侧面何老师谈，她说对孩子要严厉，
blah. 后来孩子拒绝去FCC--只要那个年老的白老师在就不去，年轻老师在就高高兴兴
的去。我和manager谈完更失望，她只顾赚钱！ 年老的白老师天天早班，孩子又死活不

昨天收到FCC的信，回复我两星期前发的抗议JK节目的complaint。一共三页纸，两页
complaint原文，一页回复，说他们不能干涉言论自由和新闻自由，不能搞censorship
。我担心ＯＣＡ对FCC的complaint也会有同样的回复。
网上不少人提议对ＡＢＣ和JK提起诉讼。以我有限的法律知识，我想从纯技术角度分析
一下诉讼的可能性。第一种情况，以hate crime提出诉讼。首先是原告的问题，如果以
节目观众的身份诉讼，则原告应为个人，团体没有standing。我相信各州应该有不少人
愿意站出来当原告。其次是如何证明这些人的伤害。联邦和加州hate crime的法律都要
求对原告有人身或财产的伤害或威胁要伤害。也就是说，首先要求证明是crime，其次
