莊豐源的父母都是內地居民，於1997年9月持雙程證在香港探親時在香港產下莊豐源。
莊豐源出生後由其擁有香港居留權的祖父照顧。2001年香港政府入境處依據香港法例第
115章《入境條例》附表1第2（a）段規定，決定將莊豐源遣返回其父母原居地。其家人
不服，遂提起訴訟。
最終由終審法院作出裁定：不論其父母是否已在香港定居，只要在香港出生的中國籍子
女均享有居港權。莊豐源符合在港出生的條件，享有在香港特區的居留權。終審法院於
2001年7月20日作出終審判決，駁回入境處處長的上訴，判定莊豐源享有香港特區居留
權。
終院並認為，案件不涉及中央管理的事，或中央與特區的關係，完全屬於特區政府管轄

I say we must re-enact the Chinese Exclusion Act of 1882 thus barring any
Chinese from entering our country. Don't laugh, this one anti-immigration
law worked very well. As you can see the U.S. has only about 2 million
people of Chinese descend and the Chinese been coming here in large numbers
since 1850. The people from India has about the same number in the U.S. but
they DIDN'T start coming into U.S. in large number since the 1980s. |
