发帖数: 1 | 4 最近看到版上热烈的讨论17财年EB2C没有发满的情况，以及可能要提起上诉，我突然想
起之前我回复过的一个帖子，可能提供了一个USCIS在明知道visa number有的情况下，
依然停发EB2C绿卡的证据，具体参考这个帖子：

leoparddl同学发的帖子时间是在2017年9月22日，而且是议员办公室问出来的消息，应
该可靠，结论是“TSC已经停止处理485的案子了，等10月1再开始”；但是按照现在公
布的数据，EB2C本来就没有发满，根本不具备内部U的前提条件。
我建议可以联系Leoparddl同学，看能否得到当时议员的回复，也许可以作为一个起诉
的证据。

you will find the average number with PD in 2006 of EB2C is about 500-700
each month. while, the 07/07, there just about 1500-1800 EB2C. So that is
not the big peak over there.

发帖数: 3179 | 28 很同意公布每个月名额的发放和使用数据的观点。
其实这个数据应该和排期作为USCIS的工作人员批件的标准。举个例子:
如果O决定这个月给EB2C 300个名额，根据inventory历史数据，O从EB2C inventory表
里面数300 * 1.5 ＝450来定排期。然后排期和450的名额上限同时发给USCIS，USCIS可
以调出所有排期前的case来审查，但是一旦发放visa达到450个后就应该停止批件。
这样我们也不用担心USCIS因为O的排期前进不够快浪费名额，O也不用担心多批件。这
个方案唯一缺点就是当月最坏情况有150个该批的PD没批，反而PD靠后的人批了。但是
到下个月也就纠正过来了。(其实这也许不算是什么缺点，现在的系统也有很多排期到
了的没批的)。所以公开每月quota并且和排期一样作为USCIS的工作指南是两全其美的
事情。我也不明白为什么O不愿意公布。
也许可以作为NIU明年的目标？

收集那些
(1)在2009年7，8，9月current的EB2C/NIWC同志们
(2)但是他们的申请当时没有批准，而到10.01.2009以后才批准的
把他们请作为原告
(3)收集EB2I在2009年7，8，9月批准的申请，分析他们的平均PD。看EB2I/NWI的PD是否
早于（1）和（2）中EB2C/NIWC.
如果（3）的结论是“否”的话，告状的理由是USCIS/DOS违反PD优先原则和多元化原则

的预测，如有错误，敬请指正.
所谓07大潮是指2007年7月vb，uscis自摆乌龙，set排期当前，致使绿卡申请激增。此后，除08年最后财季有所前
进，3年的水深火热。
有人说目前排期07大潮是罪魁祸首，其实不然。我觉的目前排期是上个世纪末dotcom
bubble，h1b 签证每年达19万5千，让大量电脑民工涌入，但移民局没有在移民政策上相应调整造成的。

发帖数: 410 | 46 EB2C和EB3C完蛋的标准完全不同，EB2一年配额2800，EB3一年2500，FY08-FY10，
EB2C超过自己的总配额三年多拿了将近6000，EB3C连自己的配额都拿不足，三年
总共少了1600，现在EB2情况吃紧，有人嚷嚷EB2完蛋了，比上不足。比下有余，
想想EB3兄弟吧。
EB2还是比EB3快两年半，这种排期至少两年的差距未来三年内会保持，明白的
EB3，还是快转EB2吧，你不是和自己人抢名额，而是和阿三EB3转EB2的抢名额。 |

的？为什么集中在几个月里，其他月份没有这么多升级？很奇怪。NIU是否能向有关部
门询问？
也有一些自然下降的。比如07年8月下降很多。 |

This shows that he is very conservative in allocating the visa number. If he
keeps doing this for March, some EB2 quota maybe wasted this year as in the
past.
We cannot rely on our calculation and assume that Oppenheimer will allow
EB2C move to Sept. 22, 2006 by the June, 2011.
EB2C need to push this from now on! |

发帖数: 4531 | 49 That's what we were trying to do. According to Oppen, both EB2C and EB3C
have exceeded quarterly quota in December. Unfortunately, we don't have
data to verify his claim. DOS has not yet release data for FY10 yet. He
also claims that there are many eb3c -> eb2c conversion cases, which seems
to be confirmed by recent I-485 inventory data published by USCIS.
We will continue following up with him regarding VB matter. If you have any
suggestion, please feel free to let me know.
