EB1B485投了1个月之后公司危险，然后投EB1A140，现在rfe了
虽然律师说不影响EB1B的485，如果公司没事的话，心里还是很不放心，希望律师说的是对的(如果谁知道律师说的不对，请让我知道)
这段日子实在太难熬了，公司不顺，绿卡不顺，不知道该怎么办 |

EB1B485投了1个月之后，我的公司比较危险，所以又投了EB1A140，如果EB1A批了，即
使没有h1b，身份也是合法的，这些都是律师说的 |

lesson for people in the future.
Our NIW 140 approved on 2007 May, and submitted NIW 485 in 2007 July.
EB1B was approved July 2009. Then we relinked our case to NIW 485. However
nothing changed for half year and we did email, phoho calls and infopass.
Still nothing happened.
So we filed a new EB1B 485 and today the case shows:
On June 21, 2010, we transferred this I485 APPLICATION TO REGISTER PERMANENT
RESIDENCE OR TO ADJU |

我现在该怎么办？公司倒闭，485也就没了吧？下周fp，但还没有ead，但似乎ead对
eb1b也没有用吧。

给移民局汇报说 没有这个人了。这个应该行的通。
但是现在公司倒闭， 就没有这个公司了。不是不就没法挂了。
你赶快和公司 HR 商量一下，看看他们具体什么时候 申请倒闭，都这时候了，他们不
会为难你的，我觉的。 |

Lawyers should be more experienced in this. Theoretically all applications
are independent.

have a job unless your company want to revoke your I-140, but why they shall revoke if they lay you off not because you leave the company? |

If the IOs do not know that this company is out of business, your 485
processing might be still approved.
This may not be true, 140 approval does not change your status. You have to
apply for 485 to make your status being AOS and you can legally stay, also
apply for EAD to make you eligible to work, all until your 485 is approved.
If 485 had any problems, one would be out of status right when the 485 was
rejected. |

是的，如果io不知道的话，确实没事，不过律师说不推荐，当时为保险起见，还是重新
申请了EB1A
律师说如果EB1A140批了而且当时485还有效的话，可以relink，当然如果485悲剧，那
什么都挂了

Now that you have already done so, just wait to see what the EB1A RFE is. It
could be quite simple. |

请EB1就是为了及时得到绿卡，否者没有意义。建议起草一封信，然后大家可以Email给
UCSIS，同时包括你的具体信息。 信的内容应该包括：
1. With the significant advance of EB2 cutoff date, we have seen that a lot
of our peers' I485 in EB2 have been recently approved from either TSC and
NSC
2. We also noticed dramatically delay in approving I485 in EB1. Especially a
lot of cases has surpassed the 4 months time frame specified by UCSIS.
