会影响OPT的申请，要知道很多人是工作了以后才回学校答辩的。
具体请咨询你们学校的DSO，只要你们没有违规，咨询学校DSO是最好的办法 |

且还很多security check，所以在这里爆料下给还在TSC苦等的兄弟个参考，估计你们
的也快了吧。还有就是我的start date是12月16号，不知道这个时间给我card

发，只是forward我的offer letter过去。我就自己又发了封信过去回复了。
结果后来就一直没消息了。1月6号，收到follow up email的回复，说我的file

B公司的attorney原本的计划是找到学校的DSO， 把I20上面的employer信息从A改成B，
这样我就可以在10/1 h1b正事生效之前保持OPT有效身份。。可是学校的DSO一个月以来
僵持不下，大有誓死不从之势。
今天recruiter和attorney一同打来电话，说他们详细研读了条例，h1b cap gap只是延
长你的opt状态继续工作，和你在哪里工作一点关系没有，我现在可以直接去B公司入职
上班。而且说ideal的情况是i20上面的employer信息一致，但现在即使不一致也一点关
系没有。。他们说的非常肯定this will work. 原话是，we are a large corporation
. we wouldn't risk this if we were not sure.
可是我自己想着还是觉得不靠谱。。毕竟i20上面白纸黑字写的是A公司的名字。我的
h1b transfer还在进行中，我这样直接去B报道是安全的吗？移民局以后会找麻烦吗？

1 如果被fire而h1尚未批准,雇主需要立刻撤销申请,所以opt仍然有效
2 如果h1批准但未生效,雇主需要撤销H1,而且你需要填i-539要求转回F1,但是OPT时间不太够,等结果时候OPT已经过期了

没有争议，争议的是这一年的学习是必须在F-1身份下完成还是说可以在其他允许全职
上学的身份（譬如H-1B，H-4）下完成。
USCIS对这个没有解释，按你给的这个链接，似乎DSO有解释权，DSO是学校的雇员，各
个学校对此的解释不一样很正常，我上面已经举了例子了。前面有人举了OPT申请被拒
的例子，但是没有给出理由，所以仍然不能确定是不是因为没有在F-1身份下注册满一
年被拒的。至少在我以前呆过的学校里，和LZ类似的情况下没有听说有谁的OPT被拒的。

我只是想把自己的经历写下来，希望对类似遭遇的同学有帮助。
我是STEM 专业，在一个nonprofit 的机构工作，OPT EAD 在2016年4月23日过期，我在
2015年12月14日提交了OPT extension 的延期，于是悲剧从这一天就开始了。 USCIS
规定不能在EAD过期的120天之前申请，我提交那天是EAD过期日之前的131天。
在提交申请的时候，我询问过学校的international office 需要准备什么材料，学校
的DSO 没有提醒过120天这个时间窗口，另外我自己也确实不知道 (怪自己功课没做足)
， 另外我们学校的很多朋友也不知道120天这个时间窗口限制，只是他们没有遇到过这
个问题。（所以学校的international office 确实也不太认真，至少没有在120天时间
窗口这个事情上对学生做好功课）。再次一定要提醒大家注意这个问题： 只能在EAD过
期前的120天之内申请，提前1天都不行！！！

I-94上的D/S 代表 Duration of Status。按照合法身份期限，而不是无限期。
对于F1学生，I-94 上的 D/S就是I-20上的日期，而且同时要保持有效学生身份，毕业
后或者OPT结束了grace period 也过了那么I94身份就是过期了，不合法了：OUT OF
STATUS.这时开始累计的日子就算unlawful presence。
但是如果学生在校学习期间（I94 D/S还没结束，如果违反了F1学生的规则（比如课时
选得太少或者非法工作）导致OUT OF STATUS的情况下，在被发现之前
是不会自动开始计算unlawful presence的。

发现，以前在学校OPT的时候最后一张I２０的information错了。OPT其间曾在一家小公
司做了２到３周的unpaid实习就离开了。一直忘通知学校DSO更改信息了。学校把我的
毕业的时间８/30/2012到９/30/2013整个一年的时间都算成在那家小公司里了。可那家
公司在我走后没几个星期就倒闭了。怎么可能继续在那里工作。也怪自己，当时签I２
０的时候也没仔细看。最近问了学校的dso说不能改了。真是后悔呀。不知道会不会有
什么影响。不知开个证明什么的管用吗？还是我已经被判了死刑了。。真是后悔呀。 |

色，种族和长相等等因素影响。
1989年被告结构性歧视黑人 (institutionalized discrimination)，因为隔着帘子太
多黑人考不上了。后来DSO就专门招了个黑人。
