因为法律审判一个基本原则是：以事实为依据，以法律为准绳。法律要判定是否有罪，
要有切实的事实根据。在诽谤罪中，所谓的“事实”是被告说出的，每个人都应当遵守
诚实这个最起码的道德准则，要对自己的话语负责，即所言必须一事实为依据，否则法
律就缺少判定有罪与否的依据，无法形成一个逻辑上自圆其说的判定。
第二，如果由原告来证明诽谤内容的真伪，那就违背了刑事诉讼中无罪推定的原则。

"A defamatory statement is presumed to be false, unless the defendant can
prove its truth." 当年英国某刊物攻击麦当劳食品就被老麦诉了，而且赢了。
这事得小叶起诉(for defamation)，国内人（律师）帮忙。偶脚着饶毅可以协助一下（
听说饶毅常在这儿深海作业）。 可以先通告NATURE我们要诉。IT会选择 撤稿择或私了。

上面那一种可以认定是侵权？可以提出何种诉讼？需要保留什么样的证据和证人？
美国没有什么案例支持？

file complaint。
今天接到对方律师函，把所有错都推到我头上，说，如果我去向BBB投诉，我的
complaint就是defamatory,他们就会起诉我。
请问，如果我向BBB投诉（我的投诉会基于事实），他们是否真的可以起诉我？起诉我
，他们的胜算的可能性有多大？
就他们给我发律师函，威胁我不得向监管机构投诉这件事来说，他们这样做是否违法？
或者违反行业规定？
