另一方面，被施暴的那一方如果也不要因为自己是受害者，就认为可以为所欲为。
再次提醒，对于脾气暴躁的丈夫或者妻子来说，头脑再发热，千万不能动手，因为
你不知道你的partner可能已经准备着一个摄像头等你入套。
当然，如果对方的确有施暴倾向，下套取证也是应该的。但是千万别给对方留下把柄。
对方可以来一个将计就计，当您在朝对方脸上吐唾沫，挂耳光的时候，可能已经有一个
摄像头在那儿了。
另一方面，即使一时犯了错误，如果你仍然是一个好父亲或者好母亲，并不等于你
的世界末日，也不等于你会自动失去抚养权。不需要对方有犯罪记录，不需要对方
打孩子骂孩子，也不需要对方吸毒酗酒。只要你能像法庭证明你虽然对你的partner
犯下了错误，但是你仍然是一个better parent，你照样可以得到custody，甚至

custody的时候把这个事件引入证据，相关证据还有你的老公即将和因为暴力事件被刑
事起诉的女人结婚。没有法院会支持把婴幼儿的抚养权交给一个有暴力倾向的家庭，特
别是那个有暴力行为的人不是婴幼儿的母亲。

甚至我看到某位女性写下了以下的结论
--孩子的爸爸打妈妈或者骂妈妈，孩子的妈妈拨打911后，这个孩子的爸爸以后想见孩子
都难了，
这些信息非常misleading，容易导致一些母亲和父亲做出错误的判断，有必要指出几点。
1，拒绝家庭暴力，无论是男女。我看到过case父亲把母亲家暴的时候偷偷录相下来，
结果
母亲丧失抚养权的。在生气的时候，也不能动手。
2，有家暴，如果只是emotional的（比如辱骂，冷暴力etc)，除非有很creditable的
证据，不要involve court and police。 因为指证的一方（大多是母亲）的case不能被
证明，court会认为这false allegation，会导致母亲lose custody。这样的case是
最common的。
3，即使家暴真的发生了，不等于，施暴一方一定丧失抚养权。曾有case，父亲对母亲
施暴
被抓，并且认罪以后还是拿到了sole custody的case。（小孩不到5岁）

前几天和朋友说起，美国体制上很大的优势是它的法律系统， The judiciary is not
corrupt. 在美国，你的权利被侵犯时候，你可以上法庭告任何人，包括告政府和警察
。这里当然希望所有家庭都幸福美满，不过不幸中的女人要知道如何保护自己，保护自
己的权利和财产，找个好律师，让法院为你做主。
说说那个案子，Holding好像有点不关题，是关于Jurisdiction。 案件中男人有被证实
的家暴，不过他好像是个好父亲。女人多次谎称Child Abuse， 女人的Credibility 受
到很大质疑。 同时，她严重违反法院判决，拒绝父亲探视孩子，被判Criminal
Contempt。 这个案子说明的一个问题不是Child Custody， 而是告诉你千万不要向法
院撒谎， 法官讨厌Liar， 律师也不喜欢代表Liar，因为Liar 的谎言被戳穿后，往往
把律师置于很不利的位置（突然出现的不利证据）。

请大学和Financial Aid，才网上查了一下，好像这种账号的钱不能随便动，是不是这
样啊？希望达人们告诉我不是。但是如果真的不能随便动，那我以前不知道，2个月前
从一个账号转出了大部分钱到我自己的帐户，我该肿么办？该转回去吗？如果转了，如
何证明这是把原来的转回去，而不是往里另外加钱呢？真头痛啊。 |
