发帖数: 12623 | 10 首先，I-485是AOS，是美国境内申请绿卡的过程。I-485申请人可以申请EAD和AP是给他
们在拿到绿卡前在美国等待的期间可以工作和出入境。如果在美国境外申请绿卡，就是
完全不同的过程，是consular processing，最后在美国境外拿到移民签证，一进入美
国就马上有绿卡，所以没有这样的在美国境内等待的这回事，也就没有EAD/AP。
男方有两个选择：
*在美国境外走consular processing，拿移民前阵给，进入美国就有绿卡
*如果女方还有H1b身份，男方可以申请H4签证，进入美国后走AOS，这样在美国等待，
可以申请EAD/AP |

+ D,因为concurrently file且140没批的case， mail room应该也会看140表里的类别
是EB2还是EB3，并检查排期到没到，否则mail room不会收下入库，会直接退回。
链接是inventory，不是demand。

发帖数: 3509 | 39 I-824可以和I-485一起提交，要等主申的绿卡批准后才会安排副申去领事馆。在境内的
话交了I-824也不能以此为理由停留在美国，因为I-824和境内身份没有直接关系。
I-824处理时间很长，可能要一年才能处理好转到DOS。
有什么情况必须要consular processing？很难想到。
consular processing能不能用美国医生的体检结果需要去问领事馆，通常是不能，要
求必须使用领事馆所在国家的指定医生。
既然人在境内，那就一起交I-485，不明白折腾的意义。 |

Consular process作为H1B的激活方法，所以这次I797批准件里要求到美国驻外使馆去
面签激活H1B。
不知道有没有什么补救措施可以要求移民局把consular process 改为在美国境内
change of status (L1 to H1B)，这样就不用去面签了，省了不少事。 还是说必须要
重新file一个I129，从头开始申请一个新的H1B?

请二排到了DOS就会通知申请人交钱，填表，交资料到NVC（national visa center）预
审。
你不会认为如果USCIS不用二排，二排就完全是摆设了吧？那奥本每年都有一大半时间
在网站上放个毫无意义的表格，是搞笑加自己打自己脸？ |

。但是家里LD没法坐长途飞机，所以希望能在美国境内从L2改为H4。
现在初步是这么计划的。
Plan A: 在我激活H1B之前，在美国境内用我的H1B consular processing的I797C批准
件帮LD递交I539,申请从L2转为H4。
这其实是在我成为H1B之前，将LD先改为H4，不知道移民局是否会批准这种申请。
Plan B：我先回国办理H1B，再以H1B入美国，一入境美国，马上帮LD递交I539申请转身
份。
不过担心从我以H1B回美国到给LD递交i539的这段时间内，她是否会被认为是out of
status？对以后的移民是否有不好影响。
Plan C: 如果A和B都不行，只能一起回国办H1B和H4签证了。

国务院审批签证申请时候的手册；网上还说没听说过人因为30/60天rule被拒AOS的，版
上的有报过吗？
那以此推断，这个新的90天rule，对移民局也是non-binding
移民局手册里对以前30/60天rule的说明，最后一句说的很清楚，应该没有什么担心的
了。
