法庭的意见是这么说的：
1. 没有法律要求USCIS去recapture，法院只能compel D去做法律要求的事情，不能
compel他们去改进法律。所以你要问一下律师：P能找到相关法律证据要求USCIS recapture吗？
2. Sliva case人法院已经考虑了，但是认为不相干，因为Sliva case里，政府承认自
己是错的，而且自发的要用recapture的方式来改正，而Sliva告的原因是认为
recapture的具体操作有问题，违反了法律。法院没有order USCIS去recpature，只是
order它以符合法律的方式去recapture。而当时USCIS自发的recpature不能成为现在法
院再次强令它recapture的依据。你要问律师：法院对Sliva的理解对吗？
同理，首席律师的作证只是说recapture是不违法的，是有先例的，so what？
很支持你们的努力，但是我想大家也很想听听律师对于继续上诉的分析。

跳槽，假如我7月份之前找到工作，而且公司也file h1b transfer 并且拿到receipt，
假设还是不能pp，那我是否最好申请一个140 EAD来保险一下？
可是申请140 ead是否默认就是马上开始使用呢？还是说可以申请来放着（只要不拿给
HR，不用来填I-9,就算是没有用，但是valid, can be used），还是用h1b transfer来
工作，等到万一说这个新公司的h1b申请被拒了（比如律师混蛋不靠谱等等原因），马
上掏出140 ead来应急？
假如这时140 EAD可用，后来h1b transfer又成功了，那么是否可以改回来继续用h1b?
当然一切的前提就是我能否申请成功140 ead。
看起来有两点难办：
1. compelling reason。我的原因（跳槽）算compelling么？觉得悬。
2. PD离visa bulletin cutoff date要一年内，这个我也够呛。

其实没完全推翻，只是限制了一下现在法院对大学的放任
背景说一下：德州大学奥斯汀分校（其实是总校好不好）在收录学生的时候把种族当作
考虑因素之一，某白人MM被拒不爽，于是状告学校录取学生的做法种族歧视。
初级法院在案子没有上庭之前判定MM败诉（Summary Judgment)。
MM上诉，上诉法院维持原判，说根据以前最高法院的判决，虽然任何与种族歧视的政府
措施都要以所谓“严格审查”的标准来断定其合（宪）法性，但在教育问题上，因为
student diversity是一个正当而且非常重要的政府目标（legitimate and compelling
state interest)，法院会尊重大学自己来掌握分寸；除非学生能证明学校的作为不正
