Most people chose to withdraw and resubmit in early 2011. This time only 0.2

EB2。 我向公司HR提出自己办EB1B，让公司support，但是公司的HR是新来的，做事很
小心，估计和律师也有一些communication，被律师bluffing了。说是现在公司有EB1B
case被audit，不想因为sponsor我的EB1B而影响到公司和其它在办绿卡的人。我只听说
过EB1B被REF，从来没有audit一说。哪位大牛给解析一下。如果有official的
statement解释sponsorEB1B对雇主有何影响就更好了。
其实现在EB2排期也比较快了，办EB1B又那么费神要review要推荐信的，答应办EB2
也没什么。主要是咽不下这口气，不能被无良律师这么欺负，他说什么就什么。 |

去年10月的PD 年初拿到140准备跳槽，新公司三个月之后给办绿卡。律师和我说最近
perm被audit特别多大概50%的样子，而且毫无规律，一旦audit就要等两年。所以让我
最好等到绿卡拿
到再跳。。。
板上各位怎么看？ |

望版主放过。。。
PERM在1月份交上去了，律师说审批需要6至8个月，工作签证在今年10月1日就满6年不
可以再次申请。律师计划PERM批准之后立刻申请快捷140，2周批准后继续延长H1。但是
因为公司很小，如果PERM被audit基本140还没有拿到H1就过期了。我听说在H1过期前可
以申请一个社区大学，利用CPT来度过PERM被audit的这段时间，等到PERM和140拿到后
继续延每年的H1。请问这样是可行的吗？
求大家帮忙，快急死了。。。 |

review standards. Is that the case?

大家有遇到过类似情况吗？
Audit的风险是应该律师承担，还是我们承担。Contract上只写了按case收费，现在又
多出这1000块，让我很难接受。
大家给点意见呀。

我觉的,律师本来就有责任把所有recuiting材料都准备完全,无论是否要audit. audit
了就把所有材料整理交上去. 不能recuiting就是走走过场,什么也不整理,就等perm撞
大运. |

的还交了1000左右。
问题就是你不加钱，最后audit失败，4000就全赔进去了。

（糊涂了，知道有大约2-5%的lay off, 但是走的人没有任何我的大部门的。应该是不
同的职位）。

The job ad requires Ph.D., but according to USCIS, the job only needs M.S.
I was asked to provide resumes of other employees in the company with Ph.D.
and their titles/job description. Also need to provide evidence that the
complexity of my job justifies Ph.D.'s requirement.

从6/24到今天，trackitt上被批地audit cases 分别pending 了:

466 天
470 天
456 天
这样推算，我的case还要再等个6个月。。。真想mj了。。。 |

AUDIT，在485排期的时候还是会跟上大部队的。是不是这样呢？有知道的能给CONFIRM

发帖数: 367 | 23 这大半是律师或公司的差错. PERM ETA9089表有两个地方提及到WAGE. 一个是
PREVAILING WAGE, 还一个是CURRENT WAGE. 后者必须大于或者等于前一个.
RECRUITMENT有一个地方必须提及WAGE: 十个工作日的公司内部通知(NOTICE OF FILING
). 这个WAGE 必须是前面提到的高的那一个,或者是个RANGE, 但是不能低于高的那个工
资. 另外一个地方是三十天的STATE WORKFORCE AGENCY POSTING, 有个别的州要求必须
DISCLOSE WAGE, 有个州不用.
如果RECRUITMENT用的是PWD, 但是CURRENT WAGE在ETA9089上又大于PWD, AUDIT以后,
DOL会认为雇主故意用少的工资打广告, 让US WORKER对这个工作不感兴趣. 这个大家都
好理解.
我比较感兴趣的是这个CURRENT WAGE比PWD高多少才会被DENY? 万一真是雇主不小心填
错表了, 差个一两百块的DOL怎么处理? 尤其是现在PERM用那么久才会被批, 被AUDIT后
更久, 等PERM DENY |

公司现在给我打广告，是Research Position, 这个职位的同事也大多是PhD.
现在经济不好怕招来一堆qualified us workers. 所以老板说Job requirment 写上
PhD in *** Engineering.
我在想这样会不会容易被Audit啊? 不写的话又怕qalified 的人太多。 |

要PD了，还能换工作吗？如果就靠H1B transfer换工作，对原来的perm和H1B会有什么

久，估计是不会再让你等两年的。
换个title file风险还是挺大的，且不说这两个职位听起来是否substantially
different，有两个PERM pending的话导致被audit的可能性就更大了，还不如老老实实
地等结果，至少你PD是保下来了。 |

DOL认为这个职位不需要phd和工作经验。
跟律师谈了下，说基本没戏。
律师说可以withdraw这个case,再重新申请,不要再写phd了。
我很有疑问:
audit的case可以withdraw吗？
withdraw以后会不会对下一个申请有影响呢？
有没有同学能指点一下？
或者推荐个律师，我再咨询下。 |

requirements are beyond what they considered "normal." So they give the
employer the opportunity to explain why the positin requires such and such
education, or this number of years of experience, etc. Right now DOL is not
issuing lots of audits, so I'm guessing this case has high requirements. |

degree level and your company asks minimum MS, it may trigger audit. However
, as long as your HR has sufficient reason to justify the requirement, it
should be fine. Like my case, my job title in general only requires BS + 2
yrs. However, we had strong points as why my position required MS + 2yrs (
presented a list of previous employees in my position all had MS degree). It
passed without audit.

MS+0.
First, 0 year expr means anyone with MS is qualified. I assume you were the
only applicant with MS in your final PERM application, right?
Then the MS is the focal point. Is MS the normal degree requirement for your
job? What are the job degree requirements for similar positions in your
company? You need to write reasons why this position requires MS? To
