长至16年才能拿到绿卡，而且每年都有2到3万人加入这个行列，不少议员提出修订议案去
取消这个10，000的每年限额，可惜由于国会辩论时间有限，这些法案都不能排上议程。
希望大家能向自己选区的国会议员发信，打电话，引起他们的注意，尽早取消这个10，00
0的限额。有一个网站 www.asylee.info 是促请大家团结作出这个努力，其实很简单，到
www.congress.org 上，搜索你所在选区的议员，然后发电子邮件给他们。

面试中给你挑个漏眼就拒了，就像咱们当年签证一样，申诉都没地方申。我周围好多人

有几千，其实还有一个类别叫refugee，一样是政治避难类，具体怎么区分我不清楚，
可能看材料怎么编，anyway，两类加起来可不就是每年2万上下 |

没包括家庭。绿卡是一家人的。就像工卡，主申请人只有一个，但拿绿卡的是一家。
还有不少以前积累下来的。
中国基本上没有难民。
所以政治庇护最近几年都是上万而不是几千。 |

最近一段时间，最火的新闻莫过于王立军进入美国总领馆事件；一时间各种新闻、传说
和解读让人不知所以。本律师想从法律角度，就其中一篇网上流传的《中共中央办公厅
关于对王立军私自进入美国驻成都总领馆并滞留事件进行调查评估的通报》谈谈看法。
我无法对该通报真伪做出评判，只对其中的一句话作法律技术分析。这句话是“王立军
进入美国驻成都总领事馆后，先与美方人员谈了有关合作交流事项，随后提出避难的请
求，并根据美方要求写了政治避难申请。”
我的结论是，这句话描述的事件经过不符合美国法律也不符合美国法定的驻外使领馆工
作程序细则，更不符合使领馆工作人员的日常习惯，所以应该不符合事实。我的分析如
下：
1. 美国移民法对外国人人权的保护基本上有庇护(Asylum)、难民(Refugee)和临时保护
身份(TPS)三个途径。按移民法INA208条款，庇护由美国境内的国土安全部移民局和司
法部移民法院管辖，必须在美国境内提出申请，填写移民局I-589表，隶属国务院的使

我们介绍过要砍一半绿卡的由阿肯色州的Cotton和乔治亚州Purdue两位共和党参议员提
出来的RAISE法案（点击链接）。昨天，以弗吉尼亚州的共和党众议员Bob Goodlatte为
首的几十个议员，全部是共和党且绝大部分是红州的议员外包括一个加州的共和党，又
推出要砍38%绿卡的HR4760法案。这两个打着将美国移民系统从家庭移民为主变成技术
移民(merit-based)为先旗号的法案，从参众两院提出它们的议员的背景就耐人寻味。
基本都是来自没什么移民的红州的议员，而不是急需技术移民的高科技地区的立法者们。
