Yes, you will receive 401k and pension simultaneously without one

签证办公室（Visa Office）通过对cut-off dates的控制，在财政年度（每年十月为财年第一个月）的前三个季度对职业移民类缓慢释放签证名额（比如在2011财年，职业移民类前三季度仅仅发出了年度总额58.6%的签证数），在最后一个季度才大幅度移动cut-off days放出大量没用完的名额。导致绿卡申请人的等待时间被延长。并且由于移民局资源有限，如果在最后一个季度没有及时处理足够的申请，绿卡签证名额就会被浪费（移民法规定，一个财年没有用完的名额不能挪到下一年使用）。近年职业移民绿卡申请严重积压，如果绿卡名额再被浪费，积压的情况就会被加剧。
按季度分配27%的职业移民绿卡名额的好处：
1. 能缩短绿卡申请人的等待时间（比如很多申请人就能在２０１１年拿到绿卡而不必等到２０１２年夏天）；
2. 尽量避免绿卡签证名额的浪费
法律依据：
ＮＩＵ聘请了专业律师对移民法进行分析研究，认为签证办公室目前的季度分配现状不符合移民法第201条27%限额规定的立法精神，我们需要做的就是敦促移民局提高效率依法办事。

time to time we see ppl asking here how long EB2C wait will be to decide if
they should go for EB1. If the backlog of EB2C is alleviated thanks to 3012,

Last year EB2C/I got almost 35K SOFAD, at least 10K is from EB1 spillover.
