发帖数: 1301 | 4 2009年冬第一次申请豁免，大使馆不给办，说不符合政策。没有关系没有后面，那就只
能先缓缓，那时DS2019表还可以延期用三年。
到了2012年原来的J1整整五年用完，申不了H1b，唯一可以考虑的是O1，所以当时在美
找工作各种艰辛。
那时也想其他办法办理J1豁免。当时咨询了几个律师，有些就说只能回国呆两年，或者
O1。
后来也了解到还可以通过IGA (Interested Government Agency) 出具advisory
opinion办理。
J1用完后找到工作办理O1，2013返美。然后就冲着IGA豁免。2014年请了律师帮忙办理
IGA，这个因为工作性质，
我的IGA--advisory opinion需要在新单位有第一作者主要贡献论文。因为科研项目各
种原因耽误，没有按照预期时间发表论文。
2015年秋，听朋友说大使馆出新政策，可以给我这类情况办理。
各方因素考虑，我的IGA-单位材料要审理9个月到一年，所以最后觉得根据新政策，再
试一次NOL豁免的路子。
2015年12月到2016年2月底，根据使馆政策，办理国内相关手续

有关tax你应该在expat专门在的forum看看关于中国/美国tax treaty和在中国年薪高于
美国的情形,有挺多像你类似的问题。随便google一下吧。mitbbs比较不适合这种问题。
你可以问你公司肯不肯，as part of the package，给你'tax-loss guarantee'和
expat tax advisory services.
tax-loss guarantee就是公司保证你不会因为double-tax或AMT-as-a-result-of-move
而损失。In other words, the company covers your potential extra loss of tax
if you do incur more taxes by taking the Shanghai position.因为你不是外派所

你到底有没有去查过官方文档啊？只是不停用日常语言在这里搅。
日常生活中的词语和法律文档是有不同的定义和含义的。
就跟resident一样，上学、国税、州税都有不同的定义，你非要用日常
生活的resident来说事有什么意义呢？法律条文说了算。
employment并不是单纯的有一份劳动合同，而是要满足一系列的测试条件
b1如果要work，也是要申请EAD的，什么情况怎么申请，uscis都有条文
否则，我只要在中国开一个外包公司，就可以很容易绕过H4不能为美国公
司工作的限制了。

下面附一个140的申请材料列表，基本背景也都包括了。2007 PhD毕业之后
一直在小公司做产品，这几年都没发表文章，十分心虚。申请140全都是靠着读书
时候发的些小破文章。一作journal只有一篇，还是LNCS冒充的，二作journal
一篇(IF:2)，其余的都是些conference文章。Review只做过两次，去年发了很多
email给各种杂志要review，都不理我，可能因为我没什么journal paper吧，不能
做peer review。后来还是PhD老板给找了一个review做。结果律师还给claim了，
貌似也没什么问题。

journal paper6篇 引用不多才28 心里还是有点紧张
两个月了还没有消息：（
OPT明年10月过期 LD的J1明年8月底过期
LD非大陆出生 不用排期
因为我们现在都是non-immigrant visa, 没有485一起file 怕万一没过就惨了。。
另外LD的J1应该是没有两年限制的
advisory opinion 也寄去2个月了也没有消息 还是pending的状态
LD明年五月底得回去一趟
也想有充足的时间拿到combo卡
所以估计最晚明年2月不管结果出来没也要硬着头皮交485了
请大家帮忙bless我们的140能快点批
并且advisory opinion可以早点收到！！！
另外，想请教一下体检。。
因为不知道什么时候交485，一直还没有弄体检的事
不知道一般预约医生的话能约到多久以后的？
是不是我们现在应该要开始预约了？

我们本来一直觉得是不用豁免的，visa, ds2019还有oisss都说不subject 2 year rule
之前怕485时被ＲＥＦ，就去要了advisory opinion, 没想到它居然说subject.搞不懂
如果这样的话 也没法转Ｈ了吧
要是140交了以后连Ｊ1都没法延期，那是不是只能回国呆两年后再提交485了？
ＬＤ目前的Ｊ1应该办豁免是不太来的及了。。
唉 advisory opinon的信还没收到 不知道上面会不会讲是根据哪一条判定的。
真心觉得他们搞错了。。不知道能dispute吗？ |

还有就是我觉得豁免和你说的advisory opinion可以一起搞。
不过advisory opinion基本上没有用，因为回复之后都是要求豁免。
现在开始搞豁免，我觉得应该来得及，同时把中国使馆材料和美国DOS材料一交，快的
话，3个月可以拿到FR。
拿到FR了，那么应该不会直接拒掉H4，只是会比较慢。
仅供楼主参考。
具体的我也不知道咋办。 |
